Holders of Ijarah Mausufah Fi Dhimmah shares can rent out their assets to the original seller after purchase on condition it does not lead to transfer of ownership to the original owner. The asset owner's share can be traded at the secondary market and an agreement be made to ensure that the original owner will buy back the asset after the rental period expires, provided the buying back cost is in accordance with the market price or the price agreed during the mention of the return purchase.
The Discussions also took note of the condition in some countries where restrictions persist in the application of Irah Mausufah fi dhimmah, particularly in the Islamic capital market industry. In this regard, the discussion urged the responsible sectors to look at the matter seriously by creating a more conducive environment for the Islamic financial products. The discussion also stressed that investment in the takaful industry needs to be carried out cautiously to fulfil the condition that:
Investments be made by a Syariah Pledge of Compliance, and made in the investment of products that are halal, avoiding the forbidden and syubhah. It is also to safeguard the interest of the Tabarru' Fund, particularly in the context of investment risk taken, balancing the issue of mismatch between the benefits of short term takaful and long-term investment, and stresses the need for incomes which do not comply with the Syariah Law through investment activities to be administered with transparency and mentioned in the annual financial report.
